premiumguarantee provides data analysis and reporting services. We process data provided by clients and deliver analytical reports and insights according to agreed specifications.

Client Responsibilities

Clients are responsible for:

Providing accurate and complete information
Ensuring they have the right to provide data for analysis
Reviewing and approving project specifications
Making timely payments according to agreed terms

Intellectual Property

All analytical reports, methodologies, and deliverables remain the property of premiumguarantee unless otherwise specified in a written agreement. Clients receive usage rights as outlined in their service agreement.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from the use of our services or analytical reports.

Our total liability for any claims arising from our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, so the above limitations may not apply to you.

Payment Terms

Payment terms are specified in individual service agreements. Payment is typically required according to the following:

Project-based services: Payment may be required upfront, in installments, or upon completion as specified in the agreement
Retainer services: Monthly or quarterly payments as agreed
Late payments may result in service suspension or termination
Refunds are handled according to our Return Policy

All prices are in US Dollars unless otherwise specified. Prices are subject to change with notice.

Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Los Angeles, California. You waive any right to a jury trial or to participate in a class action lawsuit.

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Modifications

We reserve the right to modify these Terms of Use at any time. Material changes will be notified by posting the updated Terms on this page and updating the "Last Updated" date. Continued use of our services after modifications constitutes acceptance of the updated terms.

Severability
